NEOpoker Partner Program Terms

These terms are an agreement between you and BiggBird Games Limited, a company registered in Gibraltar (no. 107899), which runs NEOpoker ("NEOpoker", "we", "us"). "You" means the person or company joining the NEOpoker Partner Program (the "Program").

By clicking "Sign up" you confirm that you have read these terms and agree to them. If you sign up on behalf of a company, you confirm that you are authorised to accept these terms for that company.

1. Joining

You must be at least 18 years old.

We review every application and can accept or decline anyone, without giving a reason. We are not liable to you if your application is declined.

You must give your full legal name, a valid email address and any other details we ask for during signup.

One account per person or company, unless we agree otherwise in writing.

2. Your account

You are responsible for keeping your login details secure. We are not liable for any loss caused by someone else using your account.

You are responsible for everything that happens under your account.

3. What you earn

You earn commission on paid NEOpoker subscriptions from customers you refer.

Your rate and how long it runs are shown in your partner dashboard. Unless your dashboard says otherwise, it is 30% of every subscription payment for 12 months per referred customer.

Commission is based on the amount the customer actually pays, after discounts and excluding taxes and fees.

Commission is paid on subscription revenue only. Free plans earn nothing.

We set our own prices and plans, and we can change them at any time. Customers you refer are NEOpoker customers, and our normal terms and policies apply to them.

4. How referrals are tracked

A referral counts when a customer signs up through your link or uses your code, and buys within 90 days of their first visit.

The first partner to refer a customer gets the credit. A later link or code from someone else does not change it.

Customers who were already NEOpoker customers before they used your link are reviewed by hand, and we decide whether commission applies.

If you believe you referred a customer who didn't use your link, email us with the details and we will look at it.

5. Payment

Commissions are held for 30 days, so refunds and chargebacks can clear.

Payouts go out monthly through Rewardful once your approved balance reaches $50, using the payout methods available in your dashboard.

If a payment is refunded or charged back, the commission on it is cancelled. If it was already paid, we deduct it from your next payout. If there's no payout within 30 days, you must repay it.

We can hold payouts while we check for suspicious activity. We may ask for identity documents or details about how you promote us before we release payment.

If we pay you commission by mistake, or because of false information from you, we can deduct it from future payouts.

You are responsible for any taxes on your earnings. We don't add anything to cover them.

If you don't log in and have no referrals for 6 months, we may close your account. Any balance below the payout minimum is then forfeited.

6. What you must not do

• Post your code or link on coupon, voucher, cashback or rebate sites. We don't work with those sites as partners.
• Refer yourself, your own accounts, people in your household or companies you own or control. These don't count as referrals.
• Bid on "NEOpoker", "neopoker.ai", "neo.poker" or any misspelling of them in paid search ads.
• Run paid ads with your link (search, social or display) without our written approval.
• Register domains, social handles or app names that contain our name, or use misspelled domains to send traffic to us.
• Use cookie stuffing, pop-ups, pop-unders, hidden frames, browser extensions or any software that sets tracking cookies without a real click, or that overwrites another partner's cookie.
• Use doorway pages or other misleading redirects.
• Send spam. Follow the anti-spam laws that apply to you, including the GDPR and ePrivacy rules in Europe and CAN-SPAM in the US.
• Promote us on sites or channels that contain illegal content or promote illegal gambling.
• Pretend to be NEOpoker, speak on our behalf, or offer discounts or deals we haven't approved.

7. How you talk about NEOpoker

• Do not claim or suggest that NEOpoker will make anyone win money, increase their winnings or guarantee results.
• Do not present NEOpoker as a tool for use during live play. It is for study away from the table.
• Do not target anyone under 18, or encourage anyone to gamble beyond their means.
• Mark paid promotion clearly: use #ad, or the platform's paid partnership label, whenever you earn from a post.
• In clips and videos: no poker room logos or real-money room software on screen, and no footage you don't have the rights to.
• Everything you say about NEOpoker must be true and not misleading.
• Don't make false or disparaging statements about NEOpoker, its products or its team.
• Follow the rules of every platform you post on.

You may say that you are a NEOpoker partner. You may not suggest that you work for NEOpoker, built the product, or that we endorse or sponsor you or anything else.

8. Your channels

You are responsible for your own website, channels and content, including:

• Making sure your content is accurate and legal, and doesn't infringe anyone's copyright, trademark or privacy.
• Making sure promoting NEOpoker doesn't break any agreement you have with someone else, such as a sponsor or a platform.
• Having a privacy policy that explains how you collect and use visitor data, where the law requires one.

9. Our brand and materials

When we accept you, you get a personal link and code.

We give you a limited, non-exclusive, revocable licence to use our name, logo and the materials in your dashboard to promote NEOpoker while you are in the Program. You can't transfer this licence.

You can make your own materials as long as they follow these terms and any brand guidelines we give you. Don't change our logo or materials, and stop using them when you leave the Program. If we ask you to take something down, do so promptly.

10. Ending the program

You can leave at any time by emailing us.

We can suspend or end your participation at any time. Reasons include, but are not limited to:

• Breaking any part of these terms.
• Misleading ads or claims, brand bidding or spam.
• Self-referrals, fake sign-ups or suspected fraud.
• Promotion methods we are not comfortable with for our brand.

If we end your participation because you broke these terms or because of fraud, any unpaid commission connected to it is forfeited. We may also claim back commission already paid on those referrals.

If you leave, or we end it for any other reason, we pay out valid commissions you've already earned, as long as your balance meets the payout minimum.

11. Changes to these terms

We may update these terms. Small changes that don't reduce your earnings can take effect straight away.

For changes that reduce your earnings or rights, we will tell you by email and in your dashboard at least 30 days before they take effect. If you don't agree, you can leave before then and we'll pay out your valid balance above the minimum. If you stay, you accept the change.

12. Relationship

You join as an independent contractor. Nothing in these terms makes you our employee, agent, partner in a legal sense, franchisee or joint venture partner. You can't make offers or promises on our behalf.

We may run other referral deals on different terms, and work with partners who compete with you. You have decided to join based on these terms only, not on any other promise.

13. Liability

Tracking software can fail. We are not liable for commission lost through tracking errors, data loss or outages, though we will try to fix any issue you report.

We are not liable for indirect or consequential losses, or for loss of revenue, profit or data.

Our total liability to you under these terms is limited to the commissions paid or payable to you in the 6 months before the claim.

14. Privacy

When you join, we collect the details you give us, such as your name, email address and payout information, to run the Program and pay you. Our privacy policy explains how we handle personal data: neopoker.ai/privacy

15. Disputes and law

If there's a disagreement, email us first and we'll try to sort it out within 10 business days.

These terms are governed by the laws of Gibraltar, and the courts of Gibraltar have jurisdiction.

16. General

You can't transfer these terms to someone else without our written consent.

If we don't enforce a right straight away, we haven't given it up.

If any part of these terms is found invalid, the rest still applies.

These terms are the full agreement between you and us about the Program. They replace any earlier versions.
